Terms and Conditions

Društvo sa ograničenom odgovornošću "MyTurn" Podgorica, a Montenegro-incorporated entity with registered office at Bulevar Svetog Petra Cetinjskog 104, Podgorica (Registration No. 51200505, TIN: 03624293), hereinafter called the "Owner" or "MyTurn," adopts these terms.

General Terms of Use and Contracting

These terms govern "MyTurn Chore App," a mobile application/web platform hosted at www.myturn.me/en.

Application Purpose: The platform facilitates household responsibility management through gamification, connecting parents who assign tasks and rewards with children who complete them and earn points.

Key Values:

  • Promoting organized family moments through task gamification
  • Developing household management solutions
  • Providing age-appropriate task guidance
  • Establishing safe, secure environments with verification and data protection
  • Delivering clear, comprehensive information
  • Cultivating responsibility and cooperation among family members
  • Continuously improving features
  • Offering timely customer support

Governing Framework: These terms are prepared and interpreted per Montenegrin law.

1. Definitions and Interpretations

1.1 Definitions

Applicable Laws: Laws applicable in Montenegro

Application: MyTurn Household Chores software solution (mobile app/web platform)

Application Users: Collectively refers to Parents and Children

Child: Individual who accepts and completes tasks, earning points and unlocking rewards

Communication Channel: Any Owner-provided communication method detailed in these terms

Cookie Policy: Published Owner policy applicable to the Application

Core Values: Fundamental values, goals, and objectives outlined in these terms

Data Protection Act: Montenegrin Personal Data Protection Act ("Official Gazette of Montenegro," nos. 79/2008, 70/2009, 44/2012, 22/2017)

Intellectual Property: Intellectual and industrial property rights including trademarks, domain names, patents, copyrights, trade secrets, software, technology, know-how, and database rights

Owner/MyTurn: Limited liability company "MyTurn" DOO Podgorica

Parent: Role of mother, father, or family member managing tasks and rewards

Privacy Policy: Published Owner policy applicable to the Application

Promotion: Owner-discretionary promotional codes, discounts, or offers

Prohibited Content: Unlawful, inappropriate, or offensive content published on the Application that is contrary to the Core Values, Terms of Use, or Applicable Laws

Registration: Application user registration process

Registration Form: Online registration form accessible after language and introductory screens

Rewards: Tangible items or recognitions created by Parents through the Application and awarded to Children after they accumulate sufficient points by completing Tasks

Tasks: Specific activities or responsibilities set by Parents for Children through the Application, which the Children are expected to complete

Terms of Use: These Terms of Use and Contracting

User Account: Account or profile created on the Application

1.2 Interpretation

  • "Third party" means any party other than Owner or Application User
  • "Suspending User Account" means temporarily or permanently disabling access
  • "Cancellation of User Account" means permanently deleting the account
  • General Terms include all appendixes
  • Gender and singular/plural usage includes all variations unless context requires otherwise
  • Section titles exist for clarity and don't affect interpretation

2. Access to the Application and User Registration

2.1 Basic Conditions for Registration

Application users must cumulatively:

  • Accurately, truthfully, and completely fill all Registration Form fields
  • Provide accurate personal information including first/last name, date of birth, gender, email, and country
  • Carefully read General Terms
  • Agree to General Terms, Privacy Policy, and Cookie Policy

The Owner reserves the right to suspend or cancel accounts if users cease meeting these conditions.

2.2 Creating a User Account

  • Each user may have only one account
  • Registration occurs via completion of the Registration Form
  • Users guarantee all identity and capacity information is truthful, accurate, and complete
  • False, inaccurate, or incomplete information may result in access denial
  • Parents select email passwords; children select usernames and passwords (confidential, non-transferable)
  • Owner sends verification codes to registered email addresses

Registration is deemed successfully completed when the Application User enters the verification code and thereby confirms their Registration.

Upon successful registration, users access accounts and modify them per preferences and technical capabilities.

2.3 General Obligations and Responsibilities

2.3.1 Security and Safety of User Account

The Owner does not guarantee account security and safety.

Users should take precautions including non-reused passwords.

2.3.2 Unauthorized Third-Party Access

Users must not allow third-party access or disclose account details.

Users are solely responsible for misuse resulting from account breaches.

The Owner doesn't guarantee registered user identity; not responsible for identity misuse.

Users must immediately notify Owner via Communication Channels of suspected theft, disclosure, or loss.

The Owner will take reasonable protective measures, potentially including suspension or cancellation.

2.3.3 Account Content

The Application User is the sole owner of the content they upload to their User Account.

The Owner has no editorial responsibility and needn't verify user-inputted content.

The Owner reserves discretion to remove Unauthorized Content without warning.

2.3.4 Application Misuse

Users must not:

  • Use accounts for unlawful purposes
  • Violate Applicable Laws or General Terms
  • Cause harm to Owner, other users, or third parties
  • Disrupt Application functioning or damage reputation

Violating users are responsible for resulting losses and damages; Owner accepts no liability for consequences.

Users particularly must refrain from:

  • Altering or modifying the Application by bypassing or disabling functions without authorization
  • Violating Intellectual Property rights
  • Breaching personal data rights
  • Using the Application to insult, defame, intimidate, or harass anyone
  • Introducing viruses, corrupted files, or harmful software
  • Engaging in acts causing harm to Owner, Application, users, or third parties

2.3.5 Reporting Application Misuse

Any user may report other users via Communication Channels for suspected violations.

The Owner will investigate allegations promptly.

The Owner may suspend and/or cancel accounts for violations.

2.4 Suspending and Cancelling User Accounts

Users may voluntarily withdraw by deleting accounts via "Delete Account" Application section.

The Owner reserves suspension/termination rights per General Terms provisions.

3. Contracting and Provision of Services

The Application supports:

  • Module for Parents
  • Module for Children

3.1 Module for Parents

3.1.1 Task Creation

Task creation involves entering parameters including:

  • Task name
  • Location/room designation
  • Task description
  • Completion step lists
  • Task image
  • Repetition numbers
  • Points awarded upon completion
  • Completion deadline
  • Image validation requirement selection
  • Parent assistance availability
  • Non-completion consequences
  • Encouragement messages

Parents may select age-appropriate predefined tasks with predetermined parameters (room, points, steps) that they can modify.

Parents are responsible for making the final decision about the appropriateness of the Tasks proposed in the App in relation to the abilities and needs of their Children. The Owner is relieved of any responsibility for potential risks or inappropriateness of Tasks created by Parents.

3.1.2 Reward Creation

Reward creation involves entering parameters including:

  • Reward name
  • Reward description
  • Reward image
  • Reward value
  • Points required
  • Intended child selection
  • Post-reward encouragement messages

Parents may select predefined rewards with predetermined parameters (value, points, image) they can modify.

The Owner is in no way responsible for providing Rewards created in the App to Children.

3.1.3 Task Verification

Parents verify correct task completion and accept or reject accordingly.

Acceptance triggers encouragement messages and automatic point distribution.

Rejection allows correction indication and improvement suggestions.

3.1.4 Tracking Children's Progress

Parents track progress via calendar views:

  • Red indicates <30% completion
  • Yellow indicates 30-70% completion
  • Green indicates >70% completion

3.1.5 Parental Responsibility

Parents ensure posted descriptions and photos:

  • Don't violate intellectual property regulations
  • Don't contain viruses, corrupted files, or harmful software
  • Don't violate personal rights regulations

Parents are responsible for ensuring that Tasks and Rewards created through the App are appropriate and safe for their Children. The Owner does not guarantee the accuracy or suitability of predefined Tasks and Rewards, and is relieved of any responsibility arising from the use of the App. The Owner is not a party to the agreement between Parents and Children regarding Tasks and Rewards created through the App.

3.1.6 Modifications to Parent Module

The Owner reserves the right to modify or update Parent Module functionalities anytime with prior user notification.

3.2 Module for Children

The module enables task review/execution, point earning, reward allocation, reward suggestions, and task requests with intuitive, motivating design.

3.2.1 Review and Execution of Tasks

Children view assigned tasks displayed with stars indicating points and room location.

Task details include name, description, step lists, points, deadline, and consequences.

Children follow instructions; parents may require image validation proof.

Images of completed Tasks will be forwarded to the Parents for verification and will be immediately deleted from the server after the Task is either accepted or rejected by the Parents.

3.2.2 Earning Points and Allocating Points to Rewards

Upon parent verification and acceptance, children receive defined points.

Rejection provides improvement feedback and encouragement to retry.

Children have the option to review available Rewards and the number of points required to obtain them, and can allocate a certain number of points to the Rewards they want to earn first. Once they collect enough points, they can request the Reward, which will then be provided by the Parents.

3.2.3 Suggesting Rewards and Requesting Tasks

Through the App, Children can send suggestions for specific Rewards they wish to earn to the Parents, which must be approved by the Parents before they appear on the Rewards screen.

Through the App, if no Task has been assigned, Children can send requests for new Tasks to the Parents.

3.2.4 Responsibility for Using the App

Children must use the App per parent instructions and rules.

Parents are responsible for supervising App usage.

3.2.5 Modifications to Children's Module

The Owner reserves the right to modify or update Children's Module functionalities anytime with prior parent notification.

4. Fees, Prices, and Payments

4.1 Registration Fee for the App

App Users can register for free on the App.

The Owner reserves rights to modify registration terms and fees anytime, with required written notice per Applicable Regulations.

5. Moderation and/or Modification of Published Content

5.1 Unauthorised Content

The Owner reserves the right to suspend or cancel the User Account of certain Application Users, as well as to remove certain types of content, using appropriate technological tools, if it becomes aware or there are indications that the activities of the Application Users or the information and content posted on the Application represent Unauthorised Content.

The Owner may implement filters deemed necessary to prevent Unauthorized Content posting.

5.2 Reporting Unauthorised Content

Users or third parties may report Unauthorized Content via Communication Channels.

The Owner examines reports with sufficiently substantiated explanations.

The Owner may discretionarily take appropriate measures on reports.

6. Responsibilities and Guarantees

6.1 Responsibilities and Guarantees Regarding the Application

The Application Users are responsible for possessing the necessary conditions and equipment for accessing the internet and using the Application.

Users may report Application access problems via Communication Channels.

The Owner directs users to appropriate resolution mechanisms.

The Owner does not guarantee the absence of errors or interruptions when accessing the Application or its content, nor that it will always be updated.

The Owner is not responsible for interruptions, connection errors, unavailability, malfunctions, internet outages, or uncontrollable events. The Owner will, except in impossible circumstances, take necessary steps to correct errors, restore communication, and update content promptly.

The Owner does not accept any responsibility for any security errors that may arise or for any damage that may be caused to the computer system (hardware and software) or mobile phone of the Application User, or to files or documents stored therein, as a result of:

  • Viruses in the computer system or mobile phone used to connect to Application content and services
  • Browser failure
  • Use of outdated system versions

6.2 Responsibilities and Obligations Regarding Published Content

The Owner does not carry out regular control and is not responsible for the content that Application Users post via the Application. Application Users are solely responsible for the legality, permissibility, and acceptability of such content.

The Owner does not conduct regular monitoring and is not responsible for how Application Users use the Application. Therefore, the Owner does not guarantee that Application Users use the Application in accordance with the General Terms or in a diligent and/or cautious manner and in accordance with Applicable Laws.

The Owner doesn't verify user identity or validate provided data truthfulness, validity, completeness, or authenticity.

By using the Application, the Application Users accept that all claims and actions they wish to initiate for legal liability arising from the actions or omissions of other Application Users or third parties will be limited to such Application Users or third parties, and that they will not take any claims and actions against the Owner.

6.3 Responsibilities and Obligations Regarding Services

Parents are solely responsible for monitoring and managing the way in which Children use the App, including, but not limited to, overseeing how Tasks are performed and activities are carried out. Parents are also responsible for the organization, coordination, and quality of the Tasks that Children take on and complete through the App.

Accordingly, App Users release the Owner from any liability that may arise from the availability, organization, execution, or implementation of Tasks, as well as from the selection and allocation of Rewards.

7. Updates and Changes to the Application

7.1 Updates of the Application

The Owner reserves the right to update, supplement, or delete information contained in the Application at any time and without prior notice, unless prior or subsequent notice is required by Applicable Laws.

The Owner reserves the right to update, modify, or supplement the appearance, presentation, access conditions, as well as all other technical and software solutions related to the Application at its own discretion.

7.2 Updating Documents of Importance for Application Operation

The Owner reserves amendment rights for General Terms, Privacy Policy, Cookie Policy, and related documentation.

The Owner notifies users of changes per Applicable Laws requirements.

Each Application User has the right to discontinue the use of the Application in the event of changes to the General Terms, Privacy Policy, Cookies Policy, or other documentation significant for the operation of the Application. However, if an Application User continues to use the Application after becoming aware or could have become aware of the changes in the documentation significant for the operation of the Application, it shall be deemed that they have fully accepted the changes.

8. Intellectual Property Rights

8.1 Intellectual Property Related to Application

The Owner is the owner or licensee of all Intellectual Property rights related to the software and the Application.

Intellectual Property rights, as well as text, images, graphic design, navigational structure, information, and content contained therein, belong to the Owner, who has the exclusive right to exploit its rights in any way, particularly the right to reproduce, distribute, publish, and transform, in accordance with Applicable Laws.

The authorisation of the Application access by the Application Users does not imply waiver, transfer, licensing, or full or partial assignment of any Intellectual Property rights by the Owner.

It is forbidden to delete, bypass or in any way change the content of the Application. In addition, modifying, copying, reusing, exploiting, reproducing, publishing, making a second or subsequent edition, uploading files, mailing, transmitting, using, processing or distributing in any way all or some of the content included in the Application for public or commercial purposes are also prohibited, except with the express written authorization of the Owner or, where applicable, with the authorization of the owner of the rights in question.

The Owner reserves suspension/blocking rights for suspected Intellectual Property abuse, including actions creating significant operational load.

8.2 Other Intellectual Property Rights

The content posted on the Application or on behalf of any third party, including but not limited to the Users of the Application, remains their exclusive property, given that those persons are fully responsible for any damage, claim and/or liability that may arise directly or indirectly from content posted by them and/or posted on their behalf.

By registering for the Application and agreeing to the General Terms, the User of the Application grants the Owner, in relation to the content he can provide, a global, irrevocable and transferable license, free of charge, with the right to sublicense, use, copy, modify, create derivative works, distribute, publish and exploit in any way that the Owner deems appropriate, with or without further communication with the User of the Application and without payment of any sums for such use. All of the foregoing shall be construed as granting the said rights only to the maximum extent permitted under the Applicable Laws.

9.2 Communication Between App Users

The Owner may facilitate communication between Parents and Children, but this in no way implies or constitutes the assumption of responsibility for the content of messages, Tasks, the manner of their execution, or the outcomes arising from such Tasks.

The Owner does not guarantee that any Application User will read a message or act in accordance with a request, as the assignment and execution of Tasks are at the sole discretion of the App User.

10. Other

10.1 Severability of Provisions of General Terms

Invalid or unenforceable provisions don't affect overall General Terms validity.

The Owner replaces void/unenforceable provisions with correct, valid ones bearing economically similar effect.

10.2 Governing Law and Jurisdiction

The relationship between the Owner and the Application User is regulated and interpreted in accordance with the General Terms and the laws of Montenegro.

Any dispute between the Owner and the Application User will be resolved before the competent court in Montenegro.
